How we can assist you

Applying for Grants of Representation with the Probate Registry

When someone passes away, most of the time, their estate cannot be handled before the Grant of Representation has been granted by the Probate Registry. However, there are situations where probate is not required. This often only occurs in cases where the deceased had a low net worth.

There are two types of Grants of Representation that entirely depend on whether the deceased person died with a Will in place or not. Where there is a valid Will, the Executor will need to apply for a Grant of Probate, however, in circumstances where the deceased died without a legally valid Will, the administrator will need to obtain a Grant of Letters of Administration.

Our solicitors can advise on whether the Grant of Representation is required, and should it be, we can provide expert assistance with the application process, ensuring the correct information is provided and making certain that there are no delays in the process.

Advising Executors or Administrators on their duties

The process of estate administration can feel daunting and emotional, especially if the deceased person was a close friend or family member. Handling estate administration on top of grief can be a difficult process, particularly with the legalities and various issues you may need to address, and it is often a lengthy process.

At Dutton Gregory, our solicitors can navigate you through the estate administration process, providing guidance on your duties and answering any concerns or queries you may have. Our team will also advise you on the potential problems you may face and how this could implicate you if not done correctly.

Assisting with the administration of an estate

In situations where you do not wish to handle the estate administration, our solicitors can carry out the entire process on your behalf from start to finish.

Our estate administration solicitors can provide assistance with:

  • Valuing the estate
  • Obtaining the death certificate
  • Opening a bank account for the estate
  • Placing a statutory advertisement
  • Gathering all assets from the deceased’s financial organisations, including bank accounts, investments, savings, pensions, insurance, etc.
  • Settling debts
  • Calculating and paying Inheritance Tax to HMRC
  • Distributing the estate to the listed beneficiaries

Our fees

The cost of legal advice is always a key consideration, and we want to be completely transparent around this. We offer competitive rates that reflect the high level of service we provide. During your initial consultation, we will get a clear understanding of your situation and what you want to achieve so we can ensure our fees are aligned with your requirements.

For straightforward matters, we typically offer fixed fee services. This means the cost is agreed at the outset and will not change unless your requirements do.

That said, not all tax, Wills and probate matters are straightforward to resolve. Where ongoing support will be needed, we will normally charge for our services on an hourly basis. In such cases, we always give a realistic estimate of costs and keep you regularly updated so you can stay in control of how much you are spending.
