This month our Clinical Negligence team settled a case for their client, a 12 year old boy, for £12.86 million.
Suffering from dystonic four-limb cerebral palsy and developmental delay, our client requires constant care and the use of a wheelchair for life. These injuries were caused due to delays by hospital staff during his birth, when he was starved of oxygen.
Carol Maunder, Partner at the firm and Head of Clinical Negligence headed the case, which took no less than 11 years to reach settlement, which involved a long protracted battle with the hospital, and involving 13 different medical experts, all of whom were required to assess and report on the welfare of our client.
Eventually, Carol and our Clinical Negligence team agreed liability for our client at a 70% litigation risk. This means our client will receive £9 million in the form of;
- A lump sum of £3 million
- £6 million as periodical payments of £50,000 per annum to aged 19
- £100,000 each year for life from age 19
This settlement enables our Negligence team buy suitable adapted accommodation for the client and his family, and ensure he has a care package to suit his needs for the rest of his life.
